Quyền sở hữu trí tuệ là quyền hợp pháp của tổ chức, cá nhân đối với tài sản trí tuệ do mình sáng tạo hoặc sở hữu. Tài sản trí tuệ bao gồm ba nhóm chính:

Quyền tác giả là quyền của tổ chức, cá nhân đối với tác phẩm do mình sáng tạo ra hoặc sở hữu.
Copyrights are the rights of organizations and individuals to works they create or own.
Quyền liên quan đến quyền tác giả (sau đây gọi là quyền liên quan) là quyền của tổ chức, cá nhân đối với cuộc biểu diễn, bản ghi âm, ghi hình, chương trình phát sóng, tín hiệu vệ tinh mang chương trình được mã hóa.
Rights related to copyright (hereinafter referred to as related rights) are the rights of organizations and individuals to performances, audio recordings, video recordings, broadcast programs, and encrypted satellite signals.

Quyền sở hữu công nghiệp là quyền của tổ chức, cá nhân đối với sáng chế, kiểu dáng công nghiệp, thiết kế bố trí mạch tích hợp bán dẫn, nhãn hiệu, tên thương mại, chỉ dẫn địa lý, bí mật kinh doanh do mình sáng tạo ra hoặc sở hữu và quyền chống cạnh tranh không lành mạnh.
Industrial property rights are the rights of organizations and individuals to inventions, industrial designs, semiconductor integrated circuit layout designs, trademarks, trade names, geographical indications, trade secrets they create or own, and the right to combat unfair competition.

Rights to plant varieties
Quyền đối với giống cây trồng là quyền của tổ chức, cá nhân đối với giống cây trồng mới do mình chọn tạo hoặc phát hiện và phát triển hoặc được hưởng quyền sở hữu.
Rights to plant varieties are the rights of organizations and individuals to new plant varieties that they have chosen to create, discovered and developed, or have the right to own.

Theo quy định của Luật Sở hữu trí tuệ, quyền sở hữu chỉ phát sinh khi chủ sở hữu đã tiến hành nộp đơn đăng ký và được cơ quan đăng ký cấp giấy chứng nhận đăng ký cho đối tượng SHTT.
According to the provisions of the Law on Intellectual Property, ownership rights only arise when the owner has submitted an application for registration and the registration authority has issued a certificate of registration for the IP object.
Mặc dù việc đăng ký là tự nguyện, không phải là thủ tục hành chính bắt buộc nhưng với các lý do sau đây, khách hàng nên cân nhắc tiến hành đăng ký sở hữu trí tuệ nhanh nhất có thể.
Although registration is voluntary and not a mandatory administrative procedure, for the following reasons, customers should consider registering intellectual property as soon as possible.
– Chỉ khi đăng ký và được cơ quan đăng ký cấp giấy chứng nhận đăng ký cho sản phẩm, quyền sở hữu trí tuệ của sản phẩm mới được phát huy.
– Only when registering and the registration authority has issued a certificate of registration for the product, the intellectual property rights of the product will be promoted.
– Chỉ khi đăng ký, chủ sở hữu mới được pháp luật bảo vệ;
– Only when registering, will the owner be protected by law;
– Chỉ khi đăng ký, chủ sở hữu mới được độc quyền sử dụng sản phẩm đăng ký trên toàn lãnh thổ Việt Nam;
– Only when registering, will the owner have the exclusive right to use the registered product throughout the territory of Vietnam
– Chỉ khi đăng ký, chủ sở hữu mới được phép chuyển nhượng, cho phép bên khác sử dụng và thu được khoản phí cho việc này;
– Only when registering, the owner is allowed to transfer, allow other parties to use and collect fees for this;
– Chỉ khi đăng ký, chủ sở hữu mới hoàn toàn yên tâm đầu tư cho việc phát triển, mở rộng sản phẩm mà không lo sợ bị bên khác làm nhái, làm giả.
– Only when registering, the owner can completely rest assured to invest in developing and expanding the product without fear of being imitated or counterfeited by others.
Như vậy, mặc dù thủ tục đăng ký SHTT là không bắt buộc nhưng với vai trò to lớn và quan trọng nêu trên, khách hàng (chủ sở hữu) nên cân nhắc sớm việc đăng ký.
Thus, although the IP registration procedure is not mandatory, with the important and important role mentioned above, customers (owners) should consider registering early.

Bước 1: Lựa chọn đối tượng đăng ký sở hữu trí tuệ
Step 1: Select the subject of intellectual property registration
Với mỗi sản phẩm đăng ký sẽ có hình thức đăng ký khác nhau, về cơ bản sẽ có các hình thức đăng ký sau:
Each registered product will have a different form of registration, basically there will be the following forms of registration:
+ Đăng ký nhãn hiệu (hay còn được gọi nhiều là đăng ký logo, thương hiệu)
+ Trademark registration (also known as logo registration, brand)
+ Đăng ký sáng chế, giải pháp hữu ích
+ Patent registration, utility solution registration
+ Đăng ký kiểu dáng công nghiệp hay còn gọi là đăng ký kiểu dáng sản phẩm
+ Industrial design registration or product design registration
+ Đăng ký chỉ dẫn địa lý
+ Geographical indication registration
+ Đăng ký bản quyền tác giả (cho các tác phẩm như bài hát, phần mềm, kịch bản, game, truyện, tạo hình, bản vẽ, âm nhạc….vv) hoặc quyền liên quan (bản ghi âm, ghi hình, chương trình biểu diễn)
+ Copyright registration (for works such as songs, software, scripts, games, stories, graphics, drawings, music, etc.) or related rights (sound recordings, video recordings, performances)
+ Đăng ký quyền liên quan đến giống cây trồng
+ Registering rights related to plant varieties.
Bước 2: Xác định cơ quan đăng ký sở hữu trí tuệ
Step 2: Identifying the intellectual property registration agency
Cơ quan đăng ký sẽ được xác định như sau:
The registration agency will be determined as follows:
– Đăng ký Sở hữu công nghiệp sẽ do Cục Sở hữu trí tuệ Việt Nam tiến hành thủ tục hành chính để nhận và cấp giấy chứng nhận đăng ký các đối tượng sở hữu công nghiệp cho cá nhân, tổ chức trong và ngoài nước;
– Industrial property registration will be carried out by the Department of Intellectual Property Vietnam conducts administrative procedures to receive and grant certificates of registration of industrial property objects for individuals and organizations at home and abroad;
– Đăng ký Bản Quyền tác giả, quyền liên quan sẽ do Cục bản quyền tác giả Việt Nam tiến hành thủ tục hành chính như trên;
– Registration of Copyright and related rights will be carried out by the Vietnam Copyright Office with the administrative procedures as above;
– Đăng ký Quyền liên quan đến giống cây trồng sẽ do Cục trồng trọt tiến hành thủ tục hành chính nêu trên.
– Registration of Rights related to plant varieties will be carried out by the Department of Crop Production with the administrative procedures mentioned above.
Bước 3: Chuẩn bị hồ sơ đăng ký đối tượng sở hữu trí tuệ
Step 3: Prepare documents for registration of intellectual property objects
Hồ sơ đăng ký cũng sẽ phụ thuộc vào từng loại hình đăng ký, khách hàng có thể tham khảo hồ sơ đăng ký được công ty chúng tôi viết chi tiết trong website công ty.
The registration documents will also depend on each type of registration, customers can refer to the registration documents written in detail by our company on the company website.
Bước 4: Nộp hồ sơ và theo dõi hồ sơ đăng ký sở hữu trí tuệ
Step 4: Submit documents and monitor intellectual property registration documents
Sau khi đã chuẩn bị xong hồ sơ đăng ký, khách hàng sẽ nộp hồ sơ tại 1 trong các cơ quan nêu trên để được tiến hành thẩm định hồ sơ đăng ký, theo dõi hồ sơ cho đến khi nhận được kết quả cuối cùng của việc đăng ký độc quyền sở hữu trí tuệ sản phẩm.
After preparing the registration documents, customers will submit the documents to one of the above agencies to have the registration documents assessed, monitor the documents until receiving the final results of the registration of intellectual property rights of the product.

Đơn đăng ký sở hữu trí tuệ sẽ được nộp tại từng cơ quan khác nhau phụ thuộc vào đối tượng đăng ký. Cụ thể:
Intellectual property registration applications will be submitted to different agencies depending on the subject of registration. Specifically:
(i) Nộp tại Cục bản quyền tác giả cho đối tượng đăng ký sở hữu trí tuệ là quyền tác giả, quyền liên quan đến tác giả
(i) Submit to the Copyright Office for intellectual property registration subjects that are copyrights and rights related to authors.
Tác giả, chủ sở hữu quyền tác giả có thể trực tiếp hoặc ủy quyền cho tổ chức, cá nhân khác nộp hồ sơ đăng ký bản quyền tác giả tại Cục bản quyền tác giả, có địa chỉ cụ thể như sau:
Authors and copyright owners can directly or authorize other organizations and individuals to submit copyright registration applications to the Copyright Office, with the following specific addresses:

(ii) Nộp tại Cục sở hữu trí tuệ cho đối tượng đăng ký sở hữu trí tuệ là sở hữu công nghiệp:

Cơ quan duy nhất tại Việt Nam có thẩm quyền đăng ký quyền sở hữu công nghiệp tại Việt Nam là Cục Sở hữu trí tuệ có trụ sở chính tại địa chỉ 384-386 đường Nguyễn Trãi, quận Thanh Xuân, Thành phố Hà Nội.
The only agency in Vietnam with the authority to register industrial property rights in Vietnam is the National Office of Intellectual Property, headquartered at 384-386 Nguyen Trai Street, Thanh Xuan District, Hanoi City.
